Privacy Policy on the Processing of Personal Data

(Articles 13 and 14 of Regulation 2016/679/EU and applicable provisions pursuant to Legislative Decree No. 196/2003 as amended by Legislative Decree 101/2018)

The undersigned Company informs you that, for the establishment and execution of the contractual relationships with you, it holds personal and fiscal data acquired verbally or through third parties, related to you, which are classified as personal data under the law.

DATA CONTROLLER

The Data Controller is AGGREGAZIONE PUBBLICO – PRIVATA SULLA LOGISTICA MARE-TERRA S.C.R.L., with registered office at Via Pontano No. 61, 80122, Naples (NA), company registration number REA NA-890484, VAT No. 07522871214, represented by its pro-tempore legal representative, who, within the scope of its prerogatives, may make use of the collaboration of specifically appointed data processors.

PROCESSING METHODS

The processing of personal data will be carried out using electronic and/or paper tools, based on logic strictly related to the purposes indicated below and in compliance with procedures and measures designed to ensure their security and confidentiality, in accordance with current legislation and the principles of lawfulness, fairness, transparency, data minimization, accuracy, storage limitation, integrity, confidentiality, and accountability.

PURPOSE OF PROCESSING

In relation to this data, we inform you that it will be processed for contractual needs and the fulfillment of legal and contractual obligations arising from the same, as well as for the effective management of commercial relationships.

The data will be processed for the duration of the contractual relationships and also afterwards for the fulfillment of legal obligations and for future commercial purposes, in the case of which consent will be obtained.

NATURE OF DATA PROVISION

The provision of data is mandatory for all legally and contractually required obligations, and therefore failure to provide such data or to allow further processing may prevent the company from proceeding with the contractual relationship.

The failure to provide any data not related to legal or contractual obligations will be evaluated on a case-by-case basis by the company and will lead to decisions related to the importance of the requested data for managing the business relationship.

For future commercial purposes, consent is optional and will not affect our contractual relationship in case of non-provision.

DATA DISSEMINATION SCOPE

The processing of data will be carried out by personnel directly employed by the Data Controller and by specifically appointed individuals who will act as data processors or persons in charge of processing.

Without prejudice to communications and disclosures made in compliance with legal obligations, the data may be communicated within Italy and/or abroad to:

  • Factoring companies

  • Credit institutions

  • Debt collection companies

  • Credit insurance companies

  • Commercial information companies

  • Professionals and consultants

PROCESSING METHODS, LOGIC, AND STORAGE PERIODS

Your data will be collected and recorded lawfully and fairly for the purposes indicated above, in compliance with the principles and provisions of Article 5(1) of the GDPR and applicable provisions pursuant to Legislative Decree No. 196/2003 as amended by Legislative Decree 101/2018.

The personal data will be processed through manual, computer, and telematic means, using logic strictly related to the same purposes and, in any case, ensuring security and confidentiality.

The personal data will be processed by the Company for the duration of the assignment and also subsequently to assert or protect its rights, or for administrative purposes, and/or to fulfill obligations arising from the applicable regulatory framework, in compliance with specific legal obligations concerning data retention.

RIGHTS OF DATA SUBJECTS

Data subjects may exercise their rights at any time in relation to the Data Controller in accordance with Articles 15-22 of EU Regulation No. 679/2016 and applicable provisions pursuant to Legislative Decree No. 196/2003 as amended by Legislative Decree 101/2018.

In accordance with, and within the limits and conditions set out by the data protection regulations concerning the exercise of rights by Data Subjects regarding the processing covered by this Privacy Policy, as a Data Subject, you have the right to:

  • Request confirmation of whether or not your personal data is being processed

  • Access your personal data and request its rectification, deletion, and notification of such actions to those to whom the data has been transferred

  • Request restriction of processing where applicable

  • Request portability of your personal data provided in cases indicated by law

  • Object to the processing of your data, specifically the right to object to decisions based solely on automated processing of your data, including profiling

  • File a complaint with the Supervisory Authority if you believe that the processing of your data violates the GDPR, pursuant to Article 77 of the GDPR
